Minutes of the Meeting of the Rootstown Township Trustees,
April 25, 2006The regular meeting of the Rootstown Township Trustees opened at 5:30 p.m. on April 25, 2006. Those in attendance were Trustees Bonnie Howe and David Armentrout, Darrell Stephens, Chief Palmer, Jim Mahood, Van Black and Julie Carpenter.
Resolution No. 2006-083 - Motion was made by David Armentrout and seconded by Bonnie Howe to accept the minutes of April 11, 2006. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent.
Bonnie asked that there be a moment of silence in memory of former Clerk Harry Dunden who passed away at the age of 101.

Resolution No. 2006-084 – Motion was made by David Armentrout and seconded by Bonnie Howe upon the recommendation of the Road Superintendent to award bid to Paul Adelman Trucking for limestone and fill sand and to Central-Allied Enterprises for asphalt. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent.
After examining some of the streets Darrell found that Sabin, Seifer, Ruth and Nina Drives located in the Baronwood Development need the curbs and gutters replaced. He asked that we amend the Issue 2 five (5) year plan to include Baronwood Development in 2007 and complete Bird Development in 2008. Darrell asked a letter be sent to Scott Miller, County Engineer requesting a cost estimate on Sabin, Seifer, Ruth and Nina Drives in Baronwood Development.
Resolution No. 2006-085 – Motion as made by David Armentrout and seconded by Bonnie Howe to amend Issue 2 to replace the curbs and gutters in Baronwood Development in 2007 (Sabin, Seifer, Ruth and Nina Drives) and complete the Bird Development in 2008. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent. Clean up day has been scheduled for Saturday, June 10th from 8 AM-12 PM at New Milford Road. The Board authorized two (2) Township employees to work for this occasion.
There were six (6) funerals since the last meeting and one more for tomorrow.
All the equipment is running good.
Darrell asked that a copy of the price list and rules and regulations for Homeland Cemetery be sent the Shorts and Wood Funeral Homes and to also inform them that people who haven’t lived in the Township within the past 6 months would be charged the non-resident fee.
The Memorial Day Services for NEOUCOM is May 15th at 1 PM.

FIRE CHIEF’S REPORT
Resolution No. 2006-087 – Motion was made by David Armentrout and seconded by Bonnie Howe to renew the participation with the Portage County HAZMAT Team at a cost not to exceed $1,466.01. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent.
Bonnie mentioned the HAZMAT Team has given the Fire Station equipment.
Chief Palmer reported during the month of February they collected $2,351.13 for non-resident ambulance billing. They have collected $4,721.28 for 2006 so far.
Chief Palmer reported they are currently approaching residents in Rootstown who have long driveways and are asking for permission to place a color stake at the end of their driveway to indicate how long the driveway is for the hose lays in case of fire.
Three members are attending a hazardous material class sponsored by the Federal Government in Las Vegas.
ZONING INSPECTOR’S REPORT
There were 11 acts of business.
Jim spoke to attorney Jim Matthews and they agreed to re-visit the Drennen property on May 3rd at 9 AM or May 5th at 9 AM. Jim will contact Mr. Drennen to see when he is available. The next court hearing is May 8th at 1 PM.
Chris Meduri is sending a letter today for the resident (Nedra Shekerko) on Ruth Drive.
The new zoning map is in.
Jim said the copy machine kept jamming he called for service and had it repaired. Bonnie asked on the behalf of Diane if Jim attends the Zoning Commission Meetings. Jim said he does attend to clarify on how to interrupt things for the Zoning Commission.
Bonnie said the Board received a letter from Chad Murdock regarding a zoning application refund to Gerald S. Spahr. Mr. Spahr owns Portage Salt and Supply. In 2003, he applied to the Board of Appeals to build storage units, the Board denied it, but agreed to ask the Trustees for a refund. To date Mr. Spahr has not received a refund. Bonnie asked Jim to review the ZBA meeting minutes dated June 17, 2003 and ask the members of the ZBA for their reasoning.
Resolution No. 2006-088 – Motion was made by David Armentrout and seconded by Bonnie Howe to set a public hearing on May 23, 2006 at 6:30 PM at the Town Hall for proposed amendment ZC-2006-002. The Board noted due to an error from the Zoning Commission secretary the proposed amendment scheduled for today should have actually been ZC 2006-001 instead of ZC 2006-002. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent.
Dave said a resident arrived late at our last meeting and was asking about his real estate signs that were being taken down. Dave said according to our regulations 420-10e signs shall not be placed on public right away.
UNFINISHED BUSINESS
Dave said Bruce Spurling hasn’t responded to his request for a proposal for the doors. The Board agreed the contractor can begin installing the windows. Dave will contact them.
NEW BUSINESS
Resolution No. 2006-089 – Motion was made by David Armentrout and seconded by Bonnie Howe to authorize $250.00 donation to the Rootstown Township Board of Education for our share of the cost of producing the Communicator, which also includes the Rootstown Township newsletter. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent.
FISCAL OFFICER
Resolution No. 2006-090 - Motion was made by David Armentrout and seconded by Bonnie Howe to pay bills on file with the clerk. Upon roll call all yeas and no nays.
JoAnn said the Prosecutor’s Office reviewed the agreement with Soil & Water Conservation Memorandum Storm Water Program. It has now been redrafted and requires Board signature.
JoAnn presented the Board with a letter from the Auditor’s Office asking if the 18.22 acres of land purchased, if ten (10) acres or more are going to be for agricultural use. If not, we need to take the CAUV recoupment. The Board agreed that none of the land would be used for this purpose.
6:30 Public Hearing ZC 2006-001
Dorothy Filing, Chairperson for the Zoning Commission was present.
JoAnn verified that this public hearing was legally advertised in the Record Courier.
Dave said on March 20, 2006 the Zoning Commission held a public hearing regarding proposed amendment ZC 2006-001 to section 310.04 Lot Requirements and was adopted upon the recommendation of the modified version from Regional Planning Commission. Chris Meduri, Prosecutor’s Office also submitted his recommendation. The section “lot width” really has no real explanation. The proposed would be to add “at building line” this would clarify to potential house builders the regulations without having to search several sections of the resolution or rely on the Zoning Inspector’s translations.
Resolution No. 2006-091 – Motion was made by David Armentrout and seconded by Bonnie Howe upon the recommendation of the Zoning Commission to amend section 310.04 #3 Lot width the distance between straight lines connecting front and rear lots at each side of the lot measured at the minimum front set back line as established in schedule 310.05 d.1. Upon roll call the vote as follows: Bonnie Howe, yea; David Armentrout, yea; Diane Dillon, absent.
The public hearing closed at 6:40 PM.
Ann Filing who is a junior at Rootstown High School was present. She is one of two girls selected to go to Buckeye Girls State, sponsored by the American Legion-Ravenna Post. She said she was interested in being a Township Trustee.
Resolution No. 2006-092 - Motion was made by David Armentrout and seconded by Bonnie Howe to enter into executive session at 6:45 PM to discuss personnel matters. Upon roll call all yeas and no nays.
Resolution No. 2006-093 - Motion was made by David Armentrout and seconded by Bonnie Howe to exit executive session at 7:04 PM. Upon roll call all yeas and no nays.
