Minutes of the Meeting of the Rootstown Township Zoning Board of Appeals
February 16, 2010The regular meeting of the ROOTSTOWN ZONING BOARD OF APPEALS was held on Tuesday, February 16, 2010 at 7:00 P.M. at the Rootstown Town Hall.

ZBA Secretary, Mary Ann GreerMr. Boring called the meeting order. Mr. Boring introduced the Board members and explained the evenings' procedures.
The first item on the agenda was a tabled application for a variance of a reduction of 60' frontage requirement to 38.13' from Section 310.04 F, 3 (450.06 B, 1) for property located on New Milford Road (Parcel No. 32-007-00-00-009-001 submitted by:
Donald Caporaletti

Ravenna, OH 44266Mr. Boring swore in Donald Caporaletti, 4966 New Milford Rd. Mr. Boring said Mr. Caporaletti had submitted two deeds to the Board. The first deed was from Emily Drennen to Charles and Betsy Lingo. The second deed was from Lingo/Drennen to Donald Caporaletti. These are the same deed Mr. Caporaletti was talking about at the January meeting. Mr. Boring asked Mr. Caporaletti what was he told when he purchased the property. This was a buildable lot. Mr. Caporaletti said they were grandfathered in. The first deed was from August 1953.
Mr. Manion had no questions.
Mrs. Milnes had no questions.
Mrs. Saillant had no questions.
Mr. Cutright asked about the one-recorded deed being in 2001. Mr. Caporaletti said that was correct.
Mr. Boring asked the audience if there were any questions, comments, or concerns. There were none.
Mr. Mahood said just to let the Board know a lot must be deeded before zoning took effect. Mr. Black was not in the office and the oldest books they could find on zoning were not dated. He was able to find some Trustee meetings that dated back to December 1964.
Mr. Manion asked splitting the property. Mr. Caporaletti said he was. It would be about 5 acres or so.
Resolution ZBA 2010-003. Mrs. Milnes made a motion to grant the variance request based on the deeds provided and it being grandfathereed in. Mr. Manion seconded it. A vote was taken as follows: Manion – Yes Milnes - Yes Saillant - Yes Cutright - Abstain Boring - Yes. The motion carried by a vote of 4/0/1.
Mr. Mahood stated that no lot could be land locked.
Resolution ZBA 2010-004. Mr. Manion made a motion to accept the minutes of January 19, 2010 meeting. Mrs. Milnes seconded it. The motion carried unanimously (5/0).
Mr. Boring made a motion to adjourn the meeting. Mr. Cutright seconded it. The meeting was adjourned.
