Minutes of the Meeting of the Rootstown Township Zoning Board of Appeals
March 21, 2006

The regular meeting of the ROOTSTOWN ZONING BOARD OF APPEALS was held on Tuesday, March 21, 2006 at 7:00 P.M. at the Rootstown Town Hall.

Mr. Kelsey called the meeting order. Mr. Kelsey introduced the Board members and explained the evenings' procedures.

The first item on the agenda was an application for a Conditional Use Permit (CUP) from Section 310.03-A-2 for a duplex to be located in the Ravenna Building Allotment (vacant land) parcel no. 32-020-11-00-178 (Lots 179. 180, & 181) in an R-V district submitted by:

Mr. Kelsey swore in Ed Wilson, 5115 Sunnybrook rd., Kent, OH 44240. Mr. Wilson stated he would like to build a duplex on the property located in the Ravenna Building Allotment.

Mr. Friedl asked Mr. Mahood if this duplex was similar to the ones already in that area. Mr. Mahood said this duplex would be similar to the others there.

Mr. Reckner had no questions.

Mr. Mills stated the property was 139 feet wide (4 lots 179, 180, 181, & 149) and on the layout, the duplex was 77 feet from the lot line on one side and on the other side it was 10 feet. Mr. Mills asked why not center the duplex. Mr. Wilson said he had a couple more lots on which he might build a house but not another duplex. Mr. Mills questioned being able to build on these lots, as you usually needed 4 lots to build on. Mr. Mills inquired as to whether there was water and sewer. Mr. Wilson said water and sewer were available.

Mr. Cutright asked Mr. Mahood about the square footage required in that area. Mr. Mahood said the requirements were 15,000 square footage per duplex and 7,000 for a home. Two or three lots were needed for a house.

Mr. Kelsey said he had several phone calls about the yards not done. Mr. Wilson said that due to the weather they couldn't get them in. All of driveways will be concrete.

Mr. Cutright asked if Mr. King had removed the shed. Mr. Wilson said it had not been done yet.

Mr. Black said he had two phone calls about there being too many duplexes in that area.

Mr. Kelsey asked the audience if there were any questions, comments, or concerns. There were none.

Mr. Kelsey reviewed the application

Resolution ZBA 2006-007. Mr. Reckner made a motion to approve the Conditional Use Permit (CUP) from Section 310.03-A-2. Mr. Friedl seconded it. A vote was taken as follows: Friedl - Yes Reckner - Yes Mills - Yes Cutright - No Kelsey - Yes. The motion carried by a vote of 4/1.

The Board heard a matter of privilege from David Ries. Mr. Reese's garage caught on fire and burned down. Mr. Mahood said there was a variance in 2004 to replace the garage with a pole building. Mr. Ries changed his mind and decided to add on to the original garage. He would like to revert back to the variance that was granted in 2004. Mr. Mahood said the variance was granted in October 2004 and expired in October 2005. Mr. Mills said Mr. Ries would have to reapply. Mr. Mahood asked if there couldn't be an extension. Mr. Friedl asked if any work had been started under the variance. Mr. Ries said he had the back of the garage taken off. Mr. Friedl said if work was started last fall then he thought it would be okay. Mr. Ries said he had taken the back off and moved all of the dirt. The Board decided it was in the hands of the Zoning Inspector.

Resolution ZBA 2006-008. Mr. Friedl made a motion to accept the minutes of the February 21, 2006. Mr. Mills seconded it. The motion carried unanimously (5/0).

Mr. Reckner made a motion to adjourn the meeting.

Mr. Kelsey adjourned the meeting.
