Minutes of the Meeting of the Rootstown Township Zoning Commission
June 19, 2006The Rootstown Township Zoning Commission held a public hearing on June 19, 2006, at 7:00 p.m. at the Rootstown Town Hall.

Judy Adamson, secretaryChair, Dorothy Filing, called the meeting to order. Everyone stood for the Pledge of Allegiance.
Paul Galido made a motion to approve the May 15, 2006 Zoning Commission minutes as presented. Dave Benedict seconded the motion and all ayes were heard.
Zoning Inspector report was next. Jim Mahood reported that Claudia James of Regional Planning Commission called to ask about subdivision regulations. The Herron Creek development was mentioned because that project met all township requirements and didn’t really have to come before the Zoning Commission; however some of the neighboring landowners objected to the whole development. The discussion centered around the thought that all platted subdivisions perhaps should come before the Zoning Commission and have that incorporated into the Zoning Resolution. Section 620.02A could be adapted to include the word “all” to the part regarding subdivisions being approved by the Zoning Commission. This will be considered at a future meeting.
Also, township property owners Mel and Lorraine Conwell of 2054 SW Mockingbird Lane, Palm City, Florida, were present to ask what procedures are needed to have their property re-zoned. Their property is 32.8 acres and located on the west side of S.R. 44, north of Sandy Lake Road and is currently zoned G-I (General Industrial). They feel it would be more marketable if it were zoned Commercial and it borders the C-2 at the present time. The Comprehensive Land Use Plan Addendum was reviewed and it does propose a consideration of re-zoning that area as Commercial, so the Zoning Commission will initiate this process.
Mrs. Filing announced a seminar on zoning is being held later in the week at Maplewood Career Center and she would be attending. Others had not received notice and Dorothy will report what she learns. It will involve a couple of presentations which she feels would be worthwhile.
Mrs. Filing announced that she received a phone call from Vice Chair, Perry Priest, stating that he is resigning from the Zoning Commission. He will also let Trustee Dave Armentrout know his decision as well. He will be thanked for his service and will be missed.
Due to the fact that Dorothy Filing will be on vacation in July and the vice chair will conduct the meeting, an election will need to take place immediately to fill the empty position. Bill Billock nominated Bob Baumgardner for Vice Chair. Mr. Baumgardner said he would accept the nomination. Dorothy Filing seconded the motion and all ayes were heard.
Next was the public hearing on Proposed Amendment 2006-003 - Section 310.06 of the township resolution. The proposed amendment involved accessory uses and buildings side and rear property line setbacks. Both the Regional Planning Commission and the Prosecutor’s Office provided their recommendations. Schedule 310.09B had no reference to include parking areas, so Regional Planning feels this proposed change should not be made. This schedule pertains to O-C, R-1, R-2, and R-V districts only and 310.06 pertains to R-3 districts only. Upon closer examination it was felt the proposed change was not needed. Also, the distance between accessory buildings and principal building has just been approved to correct a discrepancy.
Bob Baumgardner made a motion to deny proposed amendment 2006-003 at this time. Bill Billock seconded the motion and all ayes were heard.
The Planned Residential Development review was next. Maximum net density is still the greatest concern. Calculation to determine the open space and how the density figures into the equation was reviewed again. Mrs. Filing wants to send the latest approved draft of the entire PRD section to Bob Harris of Regional Planning for his informal review and invite him to the August Zoning Commission meeting.
Dave Benedict made a motion for the Zoning Commission to examine S.R. 44 north of Lynn Road to the Ravenna Township border for possible commercial zoning per the Comprehensive Land Use Plan Addendum. Bob Baumgardner seconded the motion. Vote as follows: Benedict, YES; Baumgardner, YES; Filing, YES; Galido, YES; and Billock, ABSTAIN. Passed 4/1
This will be forwarded to Regional Planning informally for suggestions to be reviewed at the next meeting - July 17th, 2006.
Paul Galido made a motion to adjourn. Bob Baumgardner seconded the motion and all ayes were heard.
